The letter, penned by Lanny Breuer and Peter Koski of Covington & Burling and obtained by POLITICO, emphasizes the importance of impartiality in law enforcement. They argued that turning law enforcement into partisan tools would seriously harm justice.

Notably, after Trump's reelection in 2024, Smith made the decision to dismiss the criminal cases he had initiated, stating that the move was influenced by Trump's return to power rather than the merits of the case. "Mr. Smith is fully committed to providing information about the work of the Special Counsel’s Office, and we are committed to working with you to provide the public an opportunity to hear directly from Mr. Smith regarding his work," they stated.
